A recent decision by bankruptcy Judge William H. Gindin in In re Central Jersey Airport Services LLC, Case No. 02-52830 (WHG), found at 2002 WL 1940813 (Bankr. D. N. J. Aug. 20), involved application of the 3rd Circuit’s standard for dismissing a Chapter 11 case as filed in bad faith, that was articulated in In re SGL Carbon, 200 F.3d 154 (3rd Cir. 1999).

While the test resulted in dismissal in SGL Carbon, it had an opposite result in Central Jersey Airport.
