Avoidance Actions Allowed After Unsecured Claims Settled

The 8th U.S. Circuit Court of Appeals recently handed down an opinion in Stalnaker v. DLC Ltd. (In re DLC Ltd.) affirming lower court decisions in which trustees were authorized to pursue avoidance actions even after all claims of unsecured creditors had been settled and resolved on the eve of trial.
