For the second time this month, a Commonwealth Court panel has ruled that a public entity — in the most recent case, a western Pennsylvania school district — must pay attorney fees to a media outlet that successfully sued it under the state’s Right to Know Law.
Media law practitioners believe that such decisions could become more common as Pennsylvania appellate courts begin to review RTK matters commenced after 2002, when amendments to the law paved the way for attorney fees to be awarded in such cases.
