Supreme Court Decides Indexing Deeds and Mortgages No Longer Required
In a decision that title insurers are trying to fully digest, the Pennsylvania Supreme Court has decided that documents transferring permanent interests in real estate do not need to be indexed after recording in order to provide constructive notice to subsequent purchasers or lenders. In doing so, the Supreme Court also determined that even though a mortgage by its own terms is for a period of years, it is nonetheless a permanent document.Highlighting the Revisions to the Child Custody Rules
