Grewal Slams Investors, Lawyers Over Email Erasure in Trade Secrets Case
The judge sanctioned four early backers of San Jose-based Clear View Technologies for evidence spoliation and scolded lawyers for disregarding “obvious red flags.”

A group of technology investors and their former counsel at Jackson Lewis have been hit with a doozy of a spoliation sanctions order in the Northern District of California.
U.S. Magistrate Judge Paul Grewal on Wednesday sanctioned four investors in San Jose-based Clear View Technologies Inc. $212,000 for failing to preserve relevant documents, throwing away computers that contained them, and running “Crap Cleaner” file-wiping software, all while facing the threat of litigation for allegedly plotting with Clear View employees to launch a rival venture.
“Any one of these transgressions … might justify sanctions,” Grewal wrote. “Taken together, there can be no doubt.”
