Exploring uncharted territory, U.S. District Judge James Donato on Wednesday agreed to postpone a computer hacking trial for three months while the plaintiff seeks new sources of litigation funding.

“This is an atypical situation. It's not something that case law is going to resolve,” Donato said before continuing Telesocial v. Orange's trial date from April 10 to July 5.

San Francisco app maker Telesocial Inc. has been scrambling to find new financial backing since its litigation funder, who has not been identified in court papers, either withdrew or refused to extend funding on March 28. That followed rulings by Donato excluding the testimony of Telesocial's two damages expert witnesses.
