The Fourth Appellate District affirmed a judgment. The court held that the trial court properly applied the independent standard of review in denying a challenge to a regional water quality control board's issuance of a fireworks permit.

The California Regional Water Quality Control Board, San Diego Region, approved a National Pollutant Discharge Elimination System (NPDES) general permit for public displays of fireworks over the region's surface waters. Coastal Environmental Rights Foundation (CERF) filed a petition for writ of mandate challenging the approval of the Fireworks Permit.
