The Third Appellate District reversed a superior court appellate division decision. The court held that a criminal laboratory analysis fee constituted a fine subject to penalty assessments.
Zack Moore was convicted of being under the influence of a controlled substance. The trial court granted Moore three years of summary probation with 110 days in custody, and imposed various fines and fees, including a criminal laboratory analysis fee to which the trial court added penalty assessments.
