The court of appeals affirmed a judgment. The court held that statutes making it a federal offense to smuggle weapons into the U.S. were properly applied to acts committed outside U.S. territory.

An undercover FBI agent was sent to the Philippines to investigate illegal arms smuggling into the U.S. There, he met arms dealer Cesar Ubaldo, who agreed not only to sell him a large quantity of high-powered weapons, but also to arrange for the weapons to be shipped to the U.S. After the weapons arrived in the U.S. Ubaldo and others were charged with conspiracy and with the illegal importation of weapons into the U.S., in violation of 18 U.S.C. §922(l) and 22 U.S.C. §§2778(b). They were tried before a jury and convicted.
