The First Appellate District vacated in part a trial court order. The court held that arbitration clauses in residential purchase agreements and listing agreements mandated arbitration of sellers' claims against their brokers and their service providers, including title companies.

Homeowners Theodore Laymon and others sued real estate brokers J. Rockcliff, Inc. and others and service providers Ticor Title Company of California and others for breach of fiduciary duty based on defendants' failure to disclose alleged kickbacks paid by the service providers to the brokers in connection with the brokers' sale of the plaintiffs' homes. Defendants moved to compel arbitration, relying on three separate agreements, at least one of which was executed by each plaintiff.
