The court of appeals reversed a judgment. The court held that a political subdivision of a state is an “employer” for purposes of the Age Discrimination in Employment Act (ADEA).

John Guido and Dennis Rankin worked as firefighters for the Mount Lemmon Fire District, a political subdivision of the State of Arizona. They were the two oldest full-time district employees when they were terminated, Guido at forty-six years of age and Rankin at fifty-four. They filed charges of age discrimination against the district with the Equal Employment Opportunity Commission (EEOC), which issued rulings in their favor, finding reasonable cause to believe the district violated the ADEA. They sued the district for age discrimination.
