The court of appeals affirmed in part and reversed in part a judgment and remanded. The court held that the district court erred in rejecting the plaintiff's expert testimony regarding the City of San Francisco's alleged noncompliance with American with Disabilities Act (ADA) accessibility guidelines.

Wheelchair-bound city resident Ivana Kirola filed a class action lawsuit against the City and County of San Francisco and related individuals, alleged they had systematically failed to comply with federal and state disability access laws. Kirola alleged that the city's public libraries, pools, Recreation and Parks Department (RecPark) facilities, and public right-of-way failed to comply with Title II of the ADA and related regulations. She sought both declaratory and injunctive relief.
