The Second Appellate affirmed a judgment. The court held that a local initiative measure mandating voter approval of any permit application pertaining to a chain store invalidly annulled executive or administrative conduct.

In November 2014, the voters of Malibu enacted Measure R, an initiative designed to limit large developments and chain establishments. The initiative required all permit applications pertaining to chain stores to be approved by the city's voters. Specifically, the initiative required that any plan approved by the city council be placed on the ballot for voter approval. Until the voters approved a specific plan, the city was barred from taking any final action on any discretionary approval relating to the proposed development.
