The Second Appellate District reversed in part a judgment of conviction. In the published portion of its opinion, the court held that prejudicially erroneous jury instructions necessitated reversal.
Pier'Angela Spaccia was charged with multiple criminal acts arising from her alleged misconduct while acting as assistant manager of the City of Bell. The alleged crimes included multiple counts of misappropriation of public funds, in violation of Penal Code §424. At trial, the court instructed the jury that Spaccia could be found guilty of misappropriation if the jury found either that she was an officer of the City of Bell, or that she was an employee charged with the receipt, safekeeping, transfer, or disbursement of public moneys. Spaccia was found guilty of five counts of misappropriation of public funds, and other crimes.
