The court of appeals affirmed a judgment. The court held that San Francisco's Pregnancy Information Disclosure and Protection Ordinance did not infringe protected speech or violate equal protection, and was not preempted by state law.

In 2011, the San Francisco Board of Supervisors signed into law the Pregnancy Information Disclosure and Protection Ordinance. The ordinance prohibited “limited services pregnancy centers' (LSPCs) from making false or misleading statements to the public about pregnancy-related services the centers offered or performed. The ordinance was enacted in response to concerns, both local and nationwide, about centers with an “anti-abortion agenda” misleading indigent women facing unexpected pregnancies into believing that the centers either offered or made referrals for abortion services.
