The Fifth Appellate District affirmed a trial court order. The court held that Prop 47 had to be construed as barring resentencing for any person convicted of a super strike offense prior to ruling on that person’s petition for resentencing, even if the super strike offense was committed subsequent to the offense for which resentencing was sought.
