Apple Inc. and Samsung Electronics Co. will return to U.S. District Judge Lucy Koh's San Jose courtroom Wednesday to answer an important question:

Do we really have to have another trial on design patent damages?

Apple, of course, won a $930 million judgment following a 2012 trial and partial retrial the following year. About $399 million was for Samsung's infringement of three Apple patents on the design of the iPhone and iPad. The trial enthralled Silicon Valley, but the U.S. Supreme Court was less impressed and agreed with Samsung that the U.S. Court of Appeals for the Federal Circuit misconstrued the law of design patent damages.
