The Fifth Appellate District affirmed a juvenile court judgment. In the published portion of its opinion, the court held that, under the vicarious consent doctrine, a parent lawfully made a surreptitious recording of her minor child and the babysitter believed to be abusing him.

Concerned that 12-year old babysitter Trever P. might be verbally or physically abusing her four-year old son, Ralph, or leaving him unattended, mother Kim turned on her cell phone's recording function and hid the phone in a cupboard. The resulting recording formed the basis for a juvenile court finding that Trever had committed multiple acts of sexual molestation against Ralph. Tever was committed to the Division of Juvenile Justice.
