The court of appeals vacated a restitution order and remanded. The court held that restitution for a wire fraud scheme was not limited to those losses stemming from the particular act for which the defendant was convicted, but could include losses from all acts that were part of a single scheme to defraud.

At three unrelated charity events in Washington, Florida, and Montana, Donald Johnson undertook to defraud donors out of charity donations. Johnson was indicted on a single count of wire fraud based on the Montana event. A jury found him guilty based on evidence pertaining to that event only. The government sought restitution for the losses incurred at all three events, contending Johnson owed over $70,000.
