The court of appeals reversed a district court order and remanded. The court held that the district court erred in rejecting a portion of the parties' accepted Rule 68 offer.

Roberta Miller sued the City of Portland and three city police officers under 42 U.S.C. §1983, alleging the officers used excessive force in an encounter with her. The city made a Rule 68 offer of judgment for $1,000, plus reasonable attorney fees to be determined by the district court. Miller accepted the offer.
