C.A. 2nd;
B279873

The Second Appellate District affirmed a judgment. The court held that a city's compliance with a statutory requirement that it require all of its police officers to certify in writing their receipt and understanding of the police department's vehicular pursuit policy did not hinge on 100 percent compliance by the officers.

During his high speed pursuit of a pickup truck, the occupants of which were believed to have been involved in an armed robbery, a City of Gardena police officer used his vehicle to bump the rear of the truck, a “pursuit intervention technique” that caused the truck to spin off its course and into a street light. The truck's passenger was killed in the collision. The decedent's mother, Irma Ramirez, filed a wrongful death action against the city.
