The Fourth Appellate District affirmed a judgment as modified. In the published portion of its opinion, the court held that dismissed charges cannot support imposition of a drug testing fee for a non-drug related offense.

After being charged with multiple offenses, including possession of a controlled substance, Michael Brooks pleaded no contest to unlawful possession of ammunition, and the remaining charges were dismissed. He was placed on probation subject to the condition, among others, that he pay a drug testing fee.
