Cal.Sup.Ct.;
S234269

The California Supreme Court reversed a court of appeal decision. The court held that the delayed discovery statute does not extend the accrual date for government claims.

From 1993 to 1994, a public high school track coach sexually molested student Latrice Rubenstein. In early 2012, when Rubenstein was about 34 years old, the latent memories of the sexual abuse resurfaced. She filed a claim with the coach's public entity employer under the Government Claims Act, but the public entity denied the claim as untimely. The trial court later sustained the public entity's demurrer without leave to amend and dismissed Rubenstein's complaint.
