The court of appeals vacated a judgment of sentence and remanded. The court held that a prior Washington state conviction for second-degree assault did not qualify as a “crime of violence” for purposes of enhanced sentencing under the U.S. Sentencing Guidelines.

Robby Robinson was convicted of two counts of being a felon in possession of a firearm. The district court enhanced Robinson's sentence based on his prior plea of guilty in Washington state court to a charge of second-degree assault, which the district court found to be a “crime of violence” under §2K2.1 of the Sentencing Guidelines.
