C.A. 4th;
D070478

The Fourth Appellate District affirmed in part and reversed in part a judgment. The court held that ambiguities in the parties' insurance policy had to be construed in favor of the insured.

Homeowners sued general contractor and developer Pulte Home Corporation for construction defects. Pulte tendered defense of the action to American Safety Indemnity Corporation (ASIC), which had issued comprehensive general liability (CGL) insurance policies to three of Pulte's subcontractors and added endorsements to those policies naming Pulte as an additional insured. ASIC declined to provide a defense. Pulte sued.
