The court of appeals affirmed a judgment. The court held that the bankruptcy court properly authorized the sale of the debtor's real property free and clear of long term leases.
Spanish Peaks Holdings II, LLC filed for Chapter 7 bankruptcy. At the time of the filing, it owned property that was subject to two long term leases. The bankruptcy court approved a plan to sell the property “free and clear” of all leases.
