The First Appellate District affirmed a judgment. The court held that a city council's adoption of a resolution authorizing the sale of certain city-owned real property was an administrative act not subject to referendum.
A hotel developer proposed to purchase land owned by the City of San Bruno for development as a hotel. The city council adopted a resolution authorizing the sale. Project opponents circulated a referendum petition to have the city council resolution put before a vote of city residents. The city clerk refused to certify the referendum petition. The opponent filed a petition for writ of mandate, seeking to compel the city clerk to certify the referendum petition.
