The Appellate Division of the Los Angeles County Superior Court reversed a judgment. The court held that the trial court acted in excess of its authority in crafting its own deferral of sentencing program for the defendant.

Jacob Marroquin was charged with various misdemeanors. The court offered him deferred sentencing, explaining that if Marroquin was “a good citizen for a year,” the court would set aside his guilty plea and dismiss the case. Marroquin agreed and entered a guilty plea.
