The Fourth Appellate District granted a petition for writ of mandate. The court held that the federal Constitution's full faith and credit clause mandated that the trial court apply the claims notice provisions of Oregon's Tort Claims Act in deciding a lawsuit against an Oregon government entity.
University of California, San Diego employee George Sutherland was loading a crate belonging to Oregon State University onto a vessel owned by the university when the crane he was operating tipped over. Sutherland was seriously injured. Sutherland sued Oregon State, alleging it caused the accident by failing to accurately record the weight of the container on its bill of lading
