Advocates for the removal of Superior Court Judge Aaron Persky have submitted enough signatures to trigger a recall election on June 5, the Santa Clara County Registrar of Voters said Tuesday.

A sampling of the 94,539 registered voters' names submitted by the recall proponents on Jan. 11 found a high percentage of valid signatures, rendering a full count unnecessary, according to the registrar's office. Santa Clara County supervisors are scheduled to receive the registrar's findings at their Feb. 6 meeting and order the election.

If the recall proponents are successful, Persky would be the first California judge ousted by voters since 1932.

Efforts to reach Persky or a representative of his retention campaign were not immediately successful Tuesday.

Persky has been pilloried by critics for the six-month sentence he imposed on former Stanford University student and swim team member Brock Turner for sexually assaulting an unconscious woman outside a campus party. Recall proponent Michele Dauber, a Stanford Law School professor, said Persky has a “long history of bias” in cases involving student-athletes and “privileged” defendants.

“That is why so many voters signed the petition,” Dauber said in a statement. “It's time for him to leave the bench and I am confident that in June the voters will agree.”

Turner served three months of his sentence before being released. He has since returned to his home state of Ohio, where he is registered as a sex offender. He has appealed his conviction, arguing that references to the assault taking place behind a dumpster were “prejudicial.”

Persky's efforts to stop the recall effort through litigation have been unsuccessful. His campaign in September sent robocalls to Santa Clara County residents featuring retired Judge LaDoris Cordell asking recipients not to sign the recall petitions.

In a statement released when the recall campaign started in July, Persky's campaign said the accusations of bias “are completely unfounded.”

“Recalling a longtime respected judge and former prosecutor over a single decision in which he followed the Santa Clara County Probation Department's recommendation sets a dangerous precedent that should concern us all,” the statement said.
