A litigation funder that sued prominent plaintiffs attorney Thomas Girardi over unpaid loans claims that he has failed to completely pay up on a $16 million deal to settle the case.
Lawyers for Law Finance Group filed court papers in LA Superior Court this week indicating that the Mill Valley-based litigation funder reached an agreement in May to settle claims that Girardi refused to turn over fees he and his firm Girardi Keese earned from cases that were promised to repay loans totaling $12,240,000 before interest.
Girardi agreed to pay Law Finance Group $16 million after a mediation session with retired Court of Appeal Justice Howard Wiener under the agreement, which was attached to a declaration filed by the funder's lawyers at the Eisner law firm. Girardi agreed to pay the amount in full by June 7, but the Eisner lawyers claim that Girardi only paid $10 million by the settlement's due date. They also claim he hadn't made any additional payment by the time of their July 8 filing.
The Eisner lawyers went to court this week seeking a judgment on the remaining $6 million, but were denied their initial, ex parte request.
Eisner's Leslie Corwin said that he and his client would let their court papers speak for themselves. Girardi didn't immediately respond to a request for comment.
Law Finance Group initially sued Girardi and his firm in California state court in January. Girardi, who is married to “Real Housewives of Beverley Hills” cast member Erika Jayne, has increasingly seen his finances scrutinized in court of late. Girardi, the firm, and Jayne were hit with another lawsuit in federal court in Arizona by lender Stillwell Madison in May claiming Girardi failed to keep up with payments on a loan of more than $5 million taken out to fund the firm's caseload. The Arizona suit, filed by lawyers at DLA Piper, claims Girardi failed to inform Stillwell Madison that he'd fallen behind on the loan from Law Finance Group.
According to a search of the Arizona docket Friday, that suit remains pending but defense counsel hasn't yet made an appearance for Girardi.
