Bayer’s “five-point plan” on how to resolve future lawsuits over Monsanto’s Roundup weedkiller, announced on Thursday, combines several strategies that include a possible new label on the pesticide, a strategic gamble on the U.S. Supreme Court and a potential claims administration process led by famed mediator Ken Feinberg.

One thing the plan doesn’t involve is another class action settlement. U.S. District Judge Vince Chhabria, who, on Wednesday, rejected a proposed $2 billion deal designed to cap Bayer’s future liability over Roundup, invited lawyers to refile a new settlement—with all his concerns addressed.
