Duane Morris filed a complaint for non-infringement of trademark Monday in California Central District Court on behalf of Coastal Cocktails d/b/a Modern Gourmet Foods. The suit contends that defendant Frankford Candy LLC has no exclusive rights to the phrase 'hot chocolate bomb', arguing that it is a generic term rather than a product name.
