The fate of an Argentine lawyer’s lawsuit against Uber Technologies Inc. now rests with the California Supreme Court, the U.S. Court of Appeals for the Ninth Circuit said Tuesday.

A Ninth Circuit panel asked the state’s high court whether Michael R. Rattagan can sue Uber for fraudulent concealment under California law. The claim is the final one remaining in a federal suit filed by Rattagan after Uber’s rocky 2016 launch in Buenos Aires left him facing aggravated tax evasion charges.
