California lawmakers are considering legislation banning secret settlements in cases involving defective products or harmful environmental conditions.

The bill, SB 1149, introduced Wednesday by Sen. Connie Leyva, D-Chino, would create a presumption that any court order sealing such legal agreements is prohibited unless a judge finds that the public interest in keeping agreement details private “clearly outweighs” disclosure. Information related to trade secrets, citizenship or immigration status, medical information and the amount of the settlement could still be shielded from public view.
