Bayer was hit with a consumer class action Monday in California Northern District Court over the sale and marketing of its Mirena IUD devices. The suit, backed by Bursor & Fisher, contends that Bayer wrongfully fails to disclose that studies show the product increases the risk of breast cancer in users. The suit brings claims including breach of implied warranty, unjust enrichment, fraud, negligence and violation of California's Unfair Competition Law. Counsel have not yet appeared for the defendant. The case is 5:22-cv-01603, Sidhu v. Bayer U.S. LLC.
