Midway through the first day of an unusual disciplinary hearing for a sitting California superior court judge, the chief of the three-jurist panel overseeing the case told the defense lawyer she was unsure about a fundamental aspect of the proceeding.

“I guess I’m just confused about the defense,” said Second District Court of Appeal Justice Judith Ashmann-Gerst in a sidebar that could be partly heard from the gallery.
