The League of Women Voters filed a lawsuit Tuesday in California Northern District Court challenging the constitutionality of a lobbying ordinance in Cupertino, California. The suit alleges that the ordinance broadly categorizes certain educational and charitable speakers as 'lobbyists' who must pay a fee, submit registration forms and fulfill reporting requirements in order to participate in civil discourse. The complaint further contends that speakers who violate the ordinance are subject to civil and criminal penalties, creating a chilling effect under the First Amendment. The lawsuit was brought by Steptoe & Johnson. Counsel have not yet appeared for the defendants. The case is 5:22-cv-04189, League of Women Voters of Cupertino-Sunnyvale v. City of Cupertino et al.
