In-house counsel at the Sierra Club sued the Environmental Protection Agency and Administrator Michael S. Regan Wednesday in California Northern District Court alleging violations of environmental protection laws. The lawsuit accuses the defendants of failing to satisfy its mandatory duty under the Clean Air Act to promulgate a state implementation plan (SIP) within two years of discovering that Texas failed to submit a SIP. Lawyers have not yet appeared for the defendant. The case is 4:23-cv-00780, Sierra Club v. Environmental Protection Agency.
