Moderna, Pfizer and BioNTech were sued for patent infringement on Tuesday in California Southern District Court. The suits, brought by Susman Godfrey on behalf of Promosome LLC, alleges that the defendant's COVID-19 vaccine relies on the plaintiff's patented method for increasing mRNA protein expression or re-engineering mRNA. Counsel have not yet appeared for the defendants. The cases are 3:23-cv-01047, Promosome LLC v. Moderna Inc. et al; 3:23-cv-01048, Promosome LLC v. Pfizer Inc. et al.
