California’s state bar is shielded under the 11th Amendment from a suit brought by a bar exam applicant whose requests for significant testing accommodations were partially denied, the U.S. Court of Appeals for the Ninth Circuit held Wednesday.

The court found that the California bar is part of state government, triggering sovereign immunity protections from federal lawsuits such as the one Benjamin Kohn brought alleging violations of the Americans with Disabilities Act.
