The U.S. Supreme Court on Monday declined to rule on the constitutionality of laws passed by Republicans in Florida and Texas regulating content moderation at large social media companies, sending the case back down to the lower courts for a “proper analysis” of the First Amendment issues.

In its decision, the Supreme Court sent two internet industry challenges to the laws back to the U.S. Courts of Appeals for the Fifth and Eleventh circuits to examine whether the statutes’ unconstitutional applications “substantially outweigh” the constitutional ones.
