The U.S. Court of Appeals for the Ninth Circuit on Monday reinstated a Northern California man's lawsuit that accuses the state bar of failing to provide him with legally required testing accommodations.

The unanimous three-judge panel sent Benjamin Kohn's Americans with Disabilities Act suit back to the U.S. District Court for the Northern District of California, finding a trial court judge did not adequately vet Kohn's claims through a three-part test the U.S. Supreme Court set out in its 2006 decision United States v. Georgia.
