Audible, the audiobook and podcast subsidiary of e-commerce giant Amazon, was hit with a privacy class action last week for allegedly diverting users' personally identifiable information to Meta Platforms Inc. through its use of tracking pixels.

Bursor & Fisher filed the complaint against Audible, which alleged violations of the California Invasion of Privacy Act, on Dec. 12 in the U.S. District Court for the Northern District of California. Plaintiffs may seek statutory damages of up to $5,000 per violation of CIPA's "wiretapping" statutes under Cal. Penal Code § 637.2. Counsel has not yet appeared for the defendant.

Bursor & Fisher, which frequently litigates similar digital privacy claims involving tracking technology in California, did not immediately respond to requests for comment.
