California's Supreme Court will consider whether lawyers can use peremptory challenges to excuse "inattentive" jurors in the wake of a state law that says such a finding is presumptively invalid.

At its weekly conference on Wednesday, the court granted review in People v. SanMiguel, a case involving the attempted murder conviction of a Thousand Oaks man. Joel SanMiguel was sentenced to 11 years to life for his role in attacking a homeless man with a baseball bat and metal pole.
