A midlevel California appellate court has revived a lawsuit accusing a local telescope manufacturer of unlawfully wiring $4.2 million to a China-based company found liable for alleged antitrust violations.

The California Court of Appeal’s Second District decision, issued Wednesday, gives plaintiff Optronic Technologies a chance to relitigate whether its fellow competitor Celestron Acquisition LLC is liable for an alleged fraudulent transfer under the Uniform Voidable Transactions Act or an alternate theory of liability.
