The Fourth Appellate District denied a petition for writ of mandate. The court held that a municipality was bound by state law on marijuana possessed for medical reasons, and had to return marijuana seized during a traffic stop following dismissal of the resulting drug charge, regardless of the general prohibition of marijuana under federal law.
Police officers of the City of Garden Grove stopped Felix Kha for failure to yield at a signal. Kha consented to a search of his car, and the officers seized a cloth bag from his front passenger seat. Inside was a smoking pipe and a plastic container labeled “Medical Cannabis.”
