Sacramento police officers arrested Steven Yount for driving while intoxicated. After being placed in the back of a patrol car, Blount became violent. He kicked out the window of the car. As officers were attempting to move Blount to a different patrol car, Blount became agitated and belligerent. He resisted the officers’ attempts to move him. Several officers eventually succeeded in placing Blount in handcuffs and leg restraints, but he continued to struggle.

Police officer Thomas Shrum attempted to subdue Blount with his Taser gun. Unfortunately, he inadvertently pulled out and discharged his sidearm, a nine-millimeter pistol. Blount suffered a wound to his left buttock.
