Joe Perez shared a house with his sister and her family. A couple of days a month, Perez’s four-year old great-niece, S.F. also stayed at the house. Police officers executing a search warrant at the house found several bindles of heroin hidden in various locations around the house, both in Perez’s room and in the front entryway.

Officers found four more bindles of heroin, which weighed approximately 2 grams, and a syringe filled with liquid inside an unlocked drawer of a chess set that was on an end table in the entry room to the residence. Officers found another syringe filled with liquid on top of a short end table inside the same entry room. They also found several bindles that contained heroin residue in plain view on top of a four-foot tall dresser in Perez’s bedroom.
