Erika de Rincon was a native and citizen of Mexico. De Rincon entered the U.S. in 1995. She married someone who was a lawful permanent resident. They had a daughter. In 1999 de Rincon traveled to Mexico to visit her sick mother. When she returned, she was detained at the border. During an interview with an Immigration Officer, she admitted to having falsely claimed to be a U.S. citizen in her attempt to enter the country. She also admitted that she knew this was illegal and that she had no documentation permitting lawful entry.
An expedited removal order was issued the same day, deeming de Rincon removable as an alien who had falsely attempted to gain admission as a U.S. States citizen.
